Changes to Terms and Conditions
Digital Voodoo may, in its sole discretion, change these T&C or any part thereof at any time.
If you are a registered Member, Digital Voodoo will notify you of any such changes via email to the email address www.michaelmikiala.com has on record for you. You will then be responsible for reading the revised T&C and ensuring that you are satisfied therewith and if not so satisfied, you are entitled to terminate your registration with Digital Voodoo.
If you are NOT a registered Member, Digital Voodoo will not be able to notify you of any changes to these T&C and it will be your responsibility to visit the Site to see whether the T&C have been amended and ensure that you are satisfied with the amendments. Should you not be satisfied with the amendments, you must refrain from using the Site in any way.
DISPUTES
Save for urgent or interim relief which may be granted by a competent court, in the event of any dispute of any nature whatsoever arising between you and Digital Voodoo on any matter provided for in, or arising out of these T&C, and not resolved through the Customer Relations Department of Digital Voodoo, then such a dispute may be submitted to confidential arbitration in terms of the expedited rules of the Arbitration Foundation of South Africa. ADDRESS FOR NOTICES
Digital Voodoo chooses as its address for all purposes under these T&C, whether in respect of court process, notice, or other documents or communication of whatsoever nature, the following address: 4th Floor, The Main Change, 20 Kruger Street, Maboneng Precinct, Johannesburg, 2094, with a copy to legal@digitalvoodoo.co (which copy must also be delivered in order for notice to be validly given).
TERM AND TERMINATION
These T&C shall commence from the date on which they are published on the Site and continue indefinitely, as amended by Digital Voodoo from time to time (as described above), for so long as the Site exists and is operational, Digital Voodoo being entitled to terminate these T&C and/or shut down the Site at any time subject to still processing any Purchases then already made.
If you fail to comply with your obligations under these T&C, including any incident
involving the payment of the price of an Order, and you fail to remedy such failure within 5 Business day’s of notice by Digital Voodoo to do so, this may (in the sole discretion of Digital Voodoo) lead to suspension of your access to the Service, or even the closing of your account and access to the Site, according to the degree of seriousness of the action in question, without prejudice to any damages which Digital Voodoo might seek.
COPYRIGHT & OTHER INTELLECTUAL PROPERTY
Any and all copyright subsisting in the Site, including these T&C, vests in Digital Voodoo and all rights not expressly granted are reserved.
